Disclosure of Our Marketing Communications, Your Choices, and Compliance with Federal and State Marketing Laws

1) Introduction and Purpose

This Marketing Practices disclosure ("Disclosure") is provided by Fedd Loans LLC ("Company," "we," "us," or "our"), which operates the APPNAME mobile application, website at https://feddloans.com/, and related services (collectively, the "App" or "Services").

We are committed to conducting our marketing activities in compliance with applicable federal and state laws, including the Controlling the Assault of Non-Solicited Pornography And Marketing Act of 2003 ("CAN-SPAM Act"), the Telephone Consumer Protection Act of 1991 ("TCPA") and its implementing regulations, the Telemarketing Sales Rule ("TSR") promulgated by the Federal Trade Commission ("FTC"), the Do Not Call provisions of the TSR, and applicable state telemarketing, email marketing, and consumer protection laws.

This Disclosure explains: (a) the types of marketing and promotional communications we may send; (b) how we obtain your consent or authorization to contact you; (c) your right to opt out of or unsubscribe from marketing communications; (d) how to manage your marketing preferences; (e) our compliance with CAN-SPAM, TCPA, TSR, and related laws; (f) our Do Not Call policy; (g) restrictions on marketing to minors; (h) third-party marketing and referral practices; and (i) how to contact us regarding your marketing preferences.

By using the App, you acknowledge that you have read and understood this Disclosure. Your consent to receive certain communications may be obtained separately, as described below.

2) Types of Marketing and Promotional Communications

We may send you various types of communications. Some are transactional or service-related and are necessary for the operation of the App and your relationship with us. Others are optional marketing or promotional communications that you may opt out of receiving.

2.1 Transactional and Service Communications

Transactional and service communications are those that are necessary to provide the Services, fulfill a request you have made, or comply with legal obligations. These include, but are not limited to: (a) confirmations of your loan application or request submission; (b) notifications when you are matched with a lender or receive a loan offer; (c) account security alerts, password reset instructions, and login notifications; (d) payment reminders and payment confirmations; (e) legally required disclosures, notices, and documents; (f) responses to your inquiries or support requests; and (g) important updates regarding changes to our Terms of Use, Privacy Policy, or other material policies.

You generally cannot opt out of transactional and service communications because they are essential to the Services. However, where we have flexibility (for example, in the channel we use to deliver certain notices), we will respect your preferences where practicable.

2.2 Marketing and Promotional Communications

Marketing and promotional communications are optional communications that promote our Services, the services of our lending partners, educational content about financial wellness, special offers, discounts, or other promotional materials. These may be sent via:

Email: Promotional emails about loan products, financial tips, new features, or special offers. We comply with the CAN-SPAM Act and provide a clear, conspicuous unsubscribe mechanism in every commercial email.

Text Messages (SMS) and Multimedia Messages (MMS): Promotional text messages about offers, reminders, or updates. We will only send marketing text messages where we have obtained your prior express written consent in accordance with the TCPA.

Push Notifications: In-app or device push notifications that may include promotional content. You may disable push notifications through your device or app settings.

In-App Messages: Messages displayed within the App, including banners, modals, or in-app notifications.

Telephone Calls: We may place outbound calls for service-related purposes. Marketing or sales calls will only be made where we have obtained your consent or where permitted by law, and we honor Do Not Call requests as described in Section 7.

Direct Mail: We may send promotional materials by postal mail. You may opt out of direct mail marketing by contacting us as described in Section 10.

4) Opt-Out and Unsubscribe Rights

You have the right to opt out of or unsubscribe from marketing communications at any time. We will process your request promptly and without charge.

4.1 Email Unsubscribe

Every commercial email we send will include a clear and conspicuous mechanism that allows you to opt out of receiving future commercial emails from us. This may be an "Unsubscribe" or "Opt Out" link at the bottom of the email. Clicking the link will remove you from our marketing email list. We will process your unsubscribe request within ten (10) business days. You may continue to receive transactional or service-related emails even after unsubscribing from marketing emails.

You may also unsubscribe by contacting us at [email protected] with the subject line "Unsubscribe from Marketing Emails" and including the email address you wish to remove. We will process your request within ten (10) business days.

4.2 Text Message Opt-Out

To stop receiving marketing text messages, reply STOP to any text message you receive from us. You may also text STOP to the short code from which you received the message. We will send you a confirmation that you have been unsubscribed. You may also opt out by contacting us at [email protected] with the subject line "Opt Out of Text Messages" and including the phone number you wish to remove. Message and data rates may apply for any messages you send to us.

4.3 Push Notification Opt-Out

You may disable push notifications at any time through your device settings or through the App's notification preferences. Disabling push notifications may limit your ability to receive certain service-related alerts.

4.4 Direct Mail Opt-Out

To opt out of receiving direct mail marketing, contact us at [email protected] with the subject line "Opt Out of Direct Mail" and include your name and mailing address. We will process your request within a reasonable period, typically within thirty (30) days.

5) Marketing Preferences and Preference Center

We strive to respect your preferences regarding how and when we contact you. You may manage your marketing preferences through the following methods:

Account Settings: If you have an account with us, you may be able to update your communication preferences through your account settings or profile. Log in to the App and navigate to the preferences or settings section to update your choices.

Contact Us: You may contact us at [email protected] to update your preferences. Please specify which types of communications you wish to receive or decline (e.g., email, text, phone, direct mail) and provide the relevant contact information (email address, phone number, mailing address) so we can accurately update our records.

Unsubscribe Links: For email communications, use the unsubscribe link in each email to opt out of future marketing emails.

We will process your preference updates within a reasonable period. Please note that it may take up to ten (10) business days for email unsubscribe requests to take effect, and up to thirty (30) days for other preference changes to be fully implemented across our systems. You may receive communications that were already in production at the time of your request.

6) CAN-SPAM Act Compliance

We comply with the CAN-SPAM Act and its implementing regulations when sending commercial email messages. Our practices include:

Accurate Header Information: We do not use false or misleading header information in our emails. The "From," "To," "Reply-To," and routing information accurately identify the person or business who initiated the message.

Non-Deceptive Subject Lines: The subject line of our commercial emails accurately reflects the content of the message and does not contain deceptive or misleading information.

Identification as an Advertisement: We clearly and conspicuously identify commercial email messages as advertisements where required by the CAN-SPAM Act, unless you have opted in to receive such messages or we have an existing business relationship with you.

Physical Postal Address: Every commercial email we send includes our valid physical postal address. Our mailing address is: Fedd Loans LLC, 232 Lyons St, Fort Collins, CO 80521-1730.

Unsubscribe Mechanism: Every commercial email includes a clear and conspicuous explanation of how you can opt out of receiving future emails. Our unsubscribe mechanism is functional and will process your request within ten (10) business days. We do not charge a fee for unsubscribing.

Honoring Opt-Out Requests: Once you opt out, we will not sell, transfer, or otherwise share your email address for the purpose of sending you commercial emails. We may retain your email address solely to honor your opt-out request and to ensure we do not inadvertently send you commercial emails in the future.

7) Do Not Call Policy

We respect your privacy and your choice not to receive telemarketing or sales calls. We maintain an internal Do Not Call list and will add your telephone number to that list upon your request. We will honor your request within a reasonable period, typically within thirty (30) days.

We also honor the National Do Not Call Registry maintained by the Federal Trade Commission. If your number is registered on the National Do Not Call Registry, we will not place telemarketing calls to that number unless we have your prior express written consent or an established business relationship that permits such calls under applicable law.

To be placed on our internal Do Not Call list, contact us at [email protected] with the subject line "Do Not Call Request" and include your name and the telephone number(s) you wish to have added. You may also call us and request to be placed on our Do Not Call list. We will confirm your request in writing or by email.

Please note that placing your number on our Do Not Call list will not prevent us from calling you for non-telemarketing purposes, such as responding to an inquiry you have made, providing account-related information, or fulfilling a request you have submitted. It also will not prevent our lending partners from contacting you if you have submitted a loan application and we have shared your information with them; you must contact each lender or partner directly to opt out of their communications.

8) Marketing to Minors

The App and our Services are intended for adults only. You must be at least 18 years of age (or the age of majority in your state of residence) to use the App and to submit a loan application or request.

We do not knowingly collect personal information from individuals under the age of 18. We do not knowingly send marketing or promotional communications to minors. If we become aware that we have inadvertently collected information from or sent communications to a minor, we will take reasonable steps to delete such information and cease such communications promptly.

If you believe that a minor has provided us with personal information or has received marketing communications from us, please contact us immediately at [email protected] so we can take appropriate action.

9) Third-Party Marketing, Referral Programs, and Affiliates

9.1 Sharing with Lenders and Partners

When you submit a loan application or request through the App, we share your information with participating lenders and financial partners so they can evaluate your request and potentially present offers. Those lenders and partners may use your information for their own marketing purposes in accordance with their privacy policies and applicable law. We do not control the marketing practices of third-party lenders or partners. We encourage you to review each lender's or partner's privacy policy and to contact them directly to opt out of their marketing communications.

9.2 Referral Programs

We may offer referral programs that allow you to refer friends or family members to the App. If you participate in a referral program, we may collect the contact information you provide for your referrals. We will only contact referred individuals in accordance with applicable law and our referral program terms. Referred individuals may opt out of receiving further communications from us at any time using the methods described in Section 4.

9.3 Affiliate and Partner Marketing

We may work with affiliates, marketing partners, or service providers who assist us in promoting our Services or who offer complementary products or services. We may share your information with such parties only where permitted by law and in accordance with our Privacy Policy. These partners may have their own marketing practices and privacy policies. We require our partners to comply with applicable law, but we are not responsible for their independent marketing activities. You may need to contact these partners directly to opt out of their communications.

9.4 Cookies and Tracking for Marketing

We and our partners may use cookies, web beacons, pixels, and similar technologies to collect information about your use of the App and other websites for analytics, advertising, and marketing purposes. This may include information about the pages you view, the links you click, and the device and browser you use. You may be able to limit or disable certain tracking through your browser settings or through industry opt-out tools. 10) Geographic and Timing Restrictions

We are mindful of applicable restrictions on the timing and geographic scope of marketing communications.

Time of Day: When placing telephone calls, we strive to avoid calling at unreasonable hours. Unless you have consented to receive calls at other times, we will not place telemarketing calls before 8:00 a.m. or after 9:00 p.m. in your local time zone, in accordance with the TSR and applicable state laws.

Geographic Scope: Our Services are intended for users in the United States. We do not knowingly send marketing communications to individuals outside the United States. If you are located outside the United States and receive communications from us, please contact us to opt out. Certain state laws may impose additional restrictions on telemarketing, email marketing, or other communications; we comply with such laws where applicable.

11) Changes to This Disclosure

We may update this Marketing Practices disclosure from time to time to reflect changes in our practices, legal requirements, or business operations. When we make material changes, we will update the Effective Date at the top of this page and may provide additional notice where required by law.

Your continued use of the App after the Effective Date of any changes constitutes your acceptance of the updated Disclosure. If you do not agree with the changes, you may discontinue use of the App and opt out of marketing communications using the methods described in Section 4.

Fedd Loans LLC is not a lender and does not make credit decisions. We provide a platform that connects users with licensed lenders and financial service providers. Loan amounts, APRs, terms, and funding timelines are determined solely by those providers and may vary by state, qualifications, and bank processing times. Offer availability is not guaranteed.
