California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA) — Your Right to Opt Out

1) Introduction and Purpose

This "Do Not Sell or Share My Personal Information" page ("Opt-Out Page") is provided by Fedd Loans LLC ("Company," "we," "us," or "our"), which operates the APPNAME mobile application, website at https://feddloans.com/, and related services (collectively, the "App" or "Services").

Under the California Consumer Privacy Act of 2018 ("CCPA"), as amended by the California Privacy Rights Act of 2020 ("CPRA"), and implementing regulations adopted by the California Privacy Protection Agency ("CPPA"), California residents and certain other consumers have the right to opt out of the "sale" and "sharing" of their personal information, as those terms are defined under applicable law.

This Opt-Out Page explains: (a) your right to opt out of the sale and sharing of personal information; (b) the definitions of "sale" and "sharing" under the CCPA and CPRA; (c) our current data practices with respect to sale and sharing; (d) how to submit an opt-out request; (e) our verification process; (f) response timelines; (g) authorized agent submissions; and (h) how to contact us with questions or concerns.

2) Definitions Under the CCPA and CPRA

Understanding the following definitions will help you exercise your rights effectively:

2.1 "Sale" of Personal Information

Under the CCPA, "sale" means selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, a consumer's personal information by the business to a third party for monetary or other valuable consideration.

This definition is broad and may include certain disclosures of personal information to third parties in exchange for something of value, even if no traditional "sale" or monetary payment occurs. For example, sharing identifiers or browsing history with advertising partners in exchange for analytics or advertising services may qualify as a "sale" under the CCPA.

2.2 "Sharing" of Personal Information

Under the CPRA, "sharing" means sharing, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, a consumer's personal information by the business to a third party for cross-context behavioral advertising, whether or not for monetary or other valuable consideration.

"Cross-context behavioral advertising" means the targeting of advertising to a consumer based on the consumer's personal information obtained from the consumer's activity across businesses, distinctly branded websites, applications, or services, other than the business, distinctly branded website, application, or service with which the consumer intentionally interacts.

2.3 "Personal Information"

"Personal information" means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. Examples include identifiers (name, email, IP address), commercial information, internet or other electronic network activity, geolocation data, and inferences drawn from such information.

2.4 "Sensitive Personal Information"

"Sensitive personal information" includes, among other categories: Social Security number, driver's license number, financial account information, precise geolocation, racial or ethnic origin, religious beliefs, health information, and contents of mail, email, or text messages. You may have additional rights to limit the use of sensitive personal information.

3) Your Rights Under the CCPA and CPRA

If you are a California resident or a consumer in a state that has adopted similar privacy laws (such as Virginia, Colorado, Connecticut, Utah, or Texas), you may have the following rights:

3.1 Right to Opt Out of Sale

You have the right to direct us not to sell your personal information at any time. We may not sell personal information after we receive and process your opt-out request, unless you subsequently provide express authorization for the sale.

3.2 Right to Opt Out of Sharing

You have the right to direct us not to share your personal information for cross-context behavioral advertising. We may not share your personal information for such purposes after we receive and process your opt-out request, unless you subsequently provide express authorization.

3.3 Right to Limit Use of Sensitive Personal Information

You have the right to limit our use and disclosure of your sensitive personal information to that use which is necessary to perform the services or provide the goods reasonably expected by an average consumer, or for other purposes permitted by law. 3.4 Other Privacy Rights

You may also have the right to know what personal information we collect, the right to delete personal information, the right to correct inaccurate personal information, and the right to non-discrimination for exercising your privacy rights. For more information, please see our Privacy Policy.

4) Our Current Data Practices

As of the Effective Date of this Opt-Out Page, Fedd Loans LLC does not sell personal information as defined under the CCPA and CPRA. We do not engage in cross-context behavioral advertising that would constitute "sharing" under the CPRA.

We share personal information only as described in our Privacy Policy, including: (a) with service providers who perform services on our behalf under contractual obligations; (b) with lenders and financial partners when you request loan or financial product options; (c) when required by law or legal process; (d) in connection with business transfers; and (e) with your consent or at your direction.

If our practices change in the future such that we sell or share personal information as defined under applicable law, we will update this Opt-Out Page and our Privacy Policy. We will honor any opt-out requests you submit, and we provide this page and opt-out form so that you may exercise your rights at any time, including if our practices change.

We also recognize and honor Global Privacy Control ("GPC") and similar browser-based or device-based opt-out preference signals where technically feasible and where required by applicable law. If you have enabled GPC or a similar signal, we will treat it as a valid opt-out request to the extent required by law.

5) How to Submit an Opt-Out Request

You may submit an opt-out request through any of the following methods:

5.1 Online Form

You may use the opt-out form provided on this page. Complete all required fields accurately and submit the form. We will process your request in accordance with the verification and response procedures described below.

5.2 Email

You may send an email to [email protected] with the subject line "Do Not Sell or Share My Personal Information" or "CCPA Opt-Out Request." Include your full name, email address, and, if possible, the phone number or other identifier associated with your account. Clearly state that you wish to opt out of the sale and sharing of your personal information.

5.3 Toll-Free Number

You may call us at the toll-free number listed on our website and in our Privacy Policy. A representative will assist you in submitting your opt-out request.

5.4 Postal Mail

You may send a written request to our mailing address: Fedd Loans LLC, 232 Lyons St, Fort Collins, CO 80521-1730. Include your full name, email address, mailing address, and a clear statement that you wish to opt out of the sale and sharing of your personal information.

We will not require you to create an account or provide more information than is necessary to verify your identity and process your request. The opt-out process is designed to be at least as easy as any process we use to collect or use personal information.

6) Verification of Your Identity

To protect your personal information from unauthorized access, we may verify your identity before processing your opt-out request. The verification process will depend on the nature of the request and the type of information we maintain.

For opt-out requests, we generally do not require extensive verification because the right to opt out is a fundamental right that does not involve disclosure of sensitive personal information. We may verify your identity by confirming that the email address or phone number you provide matches information we have on file, or by sending a confirmation link or code to your email or phone.

If we cannot verify your identity after good-faith efforts, we may deny the request and explain the reason. We will not require you to pay a fee for the verification process. If you use an authorized agent to submit a request on your behalf, we may require additional verification as described in Section 8.

7) Response Timeline

We will process and respond to your opt-out request as promptly as reasonably practicable, and in any event within the timeframes required by applicable law.

Under the CCPA and CPRA, we must process opt-out requests and cease selling or sharing the consumer's personal information within fifteen (15) business days of receiving a verifiable request. We may extend this period by an additional fifteen (15) business days if reasonably necessary, provided we inform you of the extension and the reason within the initial fifteen (15) business day period.

We will confirm receipt of your request and, upon processing, send you a confirmation that your opt-out has been honored. If we are unable to process your request, we will explain the reason and provide information on how you may appeal or contact us for further assistance.

8) Authorized Agents

You may designate an authorized agent to submit an opt-out request on your behalf. An "authorized agent" is a person or business entity registered with the California Secretary of State that a consumer has authorized to act on the consumer's behalf.

To submit a request through an authorized agent, the agent must provide: (a) proof of your written authorization for the agent to act on your behalf, or (b) proof that the agent holds a valid power of attorney pursuant to California Probate Code sections 4000 to 4465. We may also require you to verify your identity directly with us or confirm that you provided the agent permission to submit the request.

We may deny a request from an agent who does not submit proof of authorization or who fails to verify your identity when requested. Authorized agents may submit requests to [email protected] with the subject line "CCPA Opt-Out — Authorized Agent."

9) Non-Discrimination

We will not discriminate against you for exercising any of your CCPA or CPRA rights. We will not: (a) deny you goods or services; (b) charge you different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties; (c) provide you with a different level or quality of goods or services; or (d) suggest that you will receive a different price or rate or a different level or quality of goods or services.

We may, however, offer you certain financial incentives permitted by the CCPA and CPRA that can result in different prices, rates, or quality levels. Any such incentive will be described in the terms of the program, and your participation will require your prior opt-in consent. We will not use financial incentive practices that are unjust, unreasonable, coercive, or usurious in nature.

10) Consumers in Other States

If you are a resident of Virginia, Colorado, Connecticut, Utah, Texas, or another state that has adopted consumer privacy laws with opt-out rights similar to the CCPA and CPRA, you may use this Opt-Out Page and the opt-out form to exercise your rights under those laws as well.

We will process your request in accordance with the applicable law of your state of residence. Response timelines, verification requirements, and other procedures may vary slightly by jurisdiction.
